GLAMFIT FEMALE GYM MEMBERSHIP TERMS AND CONDITIONS

GlamFit Female Gym (“GlamFit”) is operated and managed by Pearl Gain Sdn Bhd (Company No. 199501001776 (330970-X) (‘the Company”). The Company has appointed a management team (“the Management”) who shall be responsible for all operation matters relating to the gym under the GlamFit brand. Glamfit has adopted policies, procedures, rules and regulations, terms and conditions (“Policies“) designed to provide for the safe, enjoyable and healthy use of the premises and events for its members and trial member(s), guest(s), purchaser(s) or user(s) (collectively known as “Member“). These policies apply to The Member conduct in premises of GlamFit, which include its centre(s) and all outdoor areas, including but is not limited to its parking lots, sidewalks (collectively known as “Premises“). They also apply to The Member conduct during its programmes, training, workshops, events or other activities off the premises involving GlamFit (collectively known as “Events“).

The following terms and conditions govern the rights and obligations of Glamfit and its Members thereof.

Glamfit provides monthly membership subscription plans with a minimum commitment. The types of memberships
provided by Glamfit are as follows: –

  1. Glamfit 3-month Membership (Not Applicable)
    Minimum commitment of three (3) full paying month. The contract will continue to run on month-to-month basis
    until cancelled in accordance to the terms and conditions herein.
  2. Glamfit 6-months Membership
    Minimum commitment of six (6) full paying months. The contract will continue to run on month-to-month basis until
    cancelled in accordance to the terms and conditions herein. This contract will be auto-renewed on monthly basis.
  3. Glamfit 12-month Membership
    Minimum commitment of twelve (12) full paying months. The contract will continue to run on month-to-month
    basis until cancelled in accordance to the terms and conditions herein. This contract will be auto-renewed on
    monthly basis.
  4. Term pay in full membership is non-transferable & refundable after purchases.
  1. Memberships are available to any individuals who have attained a minimum age of 16 years old. A parent/guardian for any applicant(s) below the age of 18 and above the age of 16 must sign on the agreement /paper contract as consent and the Parent/ Guardian Waiver and Release Form for the minor to join Glamfit and abide by the rules and regulation. Alternatively, the parent/guardian may produce a signed letter of consent to Glamfit.
  2. All new memberships and membership transfers are subject to the approval of the Management. The Management reserves the right to reject an application for membership for any reason whatsoever.
  3. Membership is personal to the Member and is non assignable, non-transferable and non-refundable. A Member may not loan her key door access to be used by a third party. Glamfit may assign the benefit of these agreements to any person, firm or company at any time without notice to the member.
  4. Upon acceptance, the Member will be issued with a key door access (which shall remain the property of the Company) and a photo of her will be registered. The Member shall be entitled to all rights and privileges under the class of membership.
  5. Any Member wishing to enter the Glamfit premises without valid membership registration and key door access will only be admitted at the imposed fee.
  6. You shall abide by all membership regulations of the Club, including any stated and customary rules for participation and use of equipment.
  7. You shall not engage in any type of commercial or business activity while using the facilities. You shall not act as a trainer for any other members or guests and any acts which constitute such business activities are strictly forbidden. If you engage in such commercial or business activities, your membership shall be subject to immediate cancellation and the balance of this Agreement declared due and payable in full immediately.
  8. You shall abide by the Club dress code at all times while in the facility. Do not wear blue jeans or any pants/shorts that have blue jean type seams or rivets. Flip-flops or bare feet are not allowed in the Club.
  9. Cell phones are not permitted in the cardio area. Photography and/or videography are not allowed anywhere in the Club.
  10. You shall not use load or profane language within the Clun nor shall you molest, badger, assault or harass other Club members, guests or employees. Doing so will subject your membership to immediate cancellation, and the balance of this Agreement being declared due and payable in full immediately.
  11. Personal training services provided in the Club may be provided either by employees or by independent contractors operating their own business. All payments for personal training services are to be made to the Club, who will pay the trainers as the services are provided.
  12. The Club prohibits the use of any drugs or steroids and you agree not to use any drugs or steroids on the Club premises. You acknowledge and are aware that steroids can cause numerous physical, mental and emotional problems relating to physical maturity and growth and may cause heart disease, strokes, liver dysfunction, sterility and infertility and many other adverse health problems. You recognize and acknowledge that there are serious criminal and civil penalties for the illegal possession, sale, use, trading, or exchange of steroids and no such activity is allowed upon Club premises.
  13. Smoking or consumption of alcohol is strictly forbidden on the Club premises.
  14. If you fail to use the Club facilities, that shall not release you from the obligation to make all payments required by the terms of this Agreement.
  15. The Club retain the right to modify these policies without warning. Reasonable rules and regulations may be posted in the Membership Guide or at the Club from time to time and all members shall be subject to strict compliance therewith. The most correct copy of the Membership Guide can be found at the Club or at the Club’s website.
  16. Coaching and training between friends/acquaintances, even for non-business/commercial purposes, is also forbidden. Coaching and guidance may be given by insured and employed staff members of Glamfit of the branch only.
  17. At Glamfit, we are committed to creating a safe, respectful, and positive environment for all members, staff, and guests. Verbal abuse of any kind—including offensive language, threats, harassment, discriminatory remarks, or any behavior that undermines the dignity of others—will not be tolerated under any circumstances.
  18. Any individual found engaging in verbal abuse will face immediate consequences, which may include warnings, suspension of membership, or permanent expulsion from the gym.
  19. We encourage anyone who witnesses or experiences verbal abuse to report the incident to our staff. All reports will be taken seriously and handled with discretion. Your respect for others ensures that our gym remains a welcoming space for all.
  1. All members shall pay an initial registration fee in the sum specified, which is non-refundable and shall become due immediately upon being accepted as a member. The initial fees are subject to change without notice.
  2. The registration fees, membership fees and any fees paid in advance are not refundable upon termination for any reason whatsoever.
  3. Monthly subscription fee is payable in advance through the auto pay system and must be settled through the payment method the Member have chosen (i.e. credit card/ bank debit arrangement) as indicated in the membership application form upon joining.
  4. Failure to use or non-usage of Glamfit’s facilities does not eliminate the obligation to pay the membership fees in a timely manner.
  5. Contract date will be the same date on the membership application form.
  6. The credit card/bank direct debit authorization amount must be sufficient to cover at least three months’ subscription outstanding plus late payment fees. In the event the selected Form of Payment (“FOP”) cannot be processed, the Member will be asked to make payments directly at Glamfit including a late payment fee (where applicable) per outstanding month. A fee of RM10 for each month of late payment will be imposed.
  7. The Management reserve the right to suspend any membership on which fees are unpaid for three (3) months or more.
  8. Suspended membership is considered cancelled if no payment has been made towards the membership for more than three (3) months. Any cancelled membership will require the Member to re-join at the prevailing registration fees.
  9. Membership Fee increase:
    1. Price promise – Glamfit agrees not to increase the Member’s monthly dues within their minimum contract period (MCP);
    2. Thereafter, Glamfit reserves the right to increase prices of any existing membership option whether individual or under a corporate account, subject to giving 30-day’s notice to the Members by posting such notification in the club, or by whatsoever means appropriate at the time;
    3. If the membership fee is increased, the Member hereby authorizes the company to increase any auto pay instruction on the FOP chosen that is indicated in the front of the membership application form upon joining accordingly.

 

  1. All Members may ‘freeze’ their membership by continuing to pay a prevailing freeze fee of RM50 per month depending on The Member membership. Freezing fee to be paid up front.
  2. Freezing fees are waived for Members (i) who are medically unfit for physical activity; and (ii) those who are pregnant. Such Members will need to provide supporting documents to the Management for processing.
  3. A Member must give 7 days’ notice before the date of the next payment date. Back dating freeze is not allowed. Freeze request shall be processed by the Management. The Management will provide a written confirmation to confirm the freeze period.
  4. The freeze period must be for period of not less than one (1) month or for a maximum of three (3) months, and the Member needs to be an active paying Member for a minimum of three (3) months after joining. Members are not allowed to request for another freeze period within six (6) months from the last day of the freeze period.
  5. The freeze period always started on your joining date and finishes on the last day of the month.
  6. The freeze period does not count towards the minimum term. Freeze may not be used in respect of the notice period for termination of membership.
  7. Any members frozen period will reactivate to a full paying membership automatically upon the expiry of the frozen period.
  8. Any members who are found using the facilities during freeze period will be required to pay the full membership fees.
  9. Membership time freeze is not applicable for all Personal Training Packages.

 

  1. May not be processed for any reason whatsoever within the first 6 months of the contract term.
  2. After 6 months, the following conditions become valid;
  3. Medical Cancellation: You may cancel this Agreement for medical reasons before the Minimum Term Expiry Date. Your doctor must provide certification that your use of the Club facilities and services would impair your health.
  4. Relocation Cancellation: You may cancel this Agreement before the Minimum Term Expiry Date by giving us 30 days’ written notice if you permanently move your residence more than 30 kilometers from any Glamfit Club with whom we have an agreement allowing you to transfer your membership privileges free of charge. We will require proof of permanent relocation. You must also tell us your new address and new phone number. Remember, if you are within 30 kilometers of any facility Club which will allow you to transfer your membership privileges free of charge, this Agreement will still be in effect.
  5. Cancellation Fee: You may cancel your membership due to medical or relocation reasons before the Minimum Term Expiry Date subject to a Cancellation fee of RM200 plus 1 month of membership fees.
  6. Cancellation after the Minimum Term Expiry Date: You can cancel your membership after the Minimum Term by delivering to the Club during manned hours a 30-day written notice. Cancellation will commence on your next direct debit date after the 30-day notice.
  7. The Club retains the right to cancel or suspend the membership of any person for any reason. If such cancellation or suspension is made due to a breach of any of the terms of this Agreement, including the Membership Policies and Safety Notices, or due to damage rendered by you, the balance of your financial obligations under this Agreement shall become due and payable in full immediately, in addition to a RM200 cancellation fee. In case where the facility or its contents are damaged, you will also be responsible for the repair or replacement thereof.

 

You agree to pay a RM60 late fee if your monthly payment is received past the due date and/or any fee associated with returned payments or non-payment of dues. Should you default, you agree to pay all collection costs including agency fees or administration charges, court or arbitration costs and reasonable attorney fees, which may be paid or incurred by the Club.

In the event of any dispute arising out of or in connection with this Agreement, including any question regarding its existence, termination or validity, or breach thereof (” Disputes”), you agree to enter into mediation for a minimum of seven (7) days prior to initiating any legal action against the Club. The mediation will take place between you and a relevant representative of the Club to be appointed at the Club’s sole and absolute discretion. During this period of seven (7) days, you agree not to disclose any information relating to the said Dispute or the mediation thereof to the public domain without the written consent of the Club. If following mediation, you and the Club are unable to reach a mutually satisfactory resolution of the Dispute, such Dispute shall be governed by, and construed in accordance with the laws of Malaysia and you and the Club agree to submit to the non-exclusive jurisdiction of the Malaysia Courts. You agree the Club shall be entitled to recover all costs and expenses resulting from the engagement of attorneys, where applicable.

This Agreement constitutes the entire agreement between the parties. All conditions, warranties or other terms not expressly contained in this Agreement (actual or implied), or not imposed or requires to be binding by applicable statute in respect of the services or goods supplied by us, our employees, servants or agents, are hereby excluded. The parties acknowledge that they have not relied on any oral or written representations or other promises or assurances not contained in this Agreement. The Parties waive all rights and remedies which might otherwise be available to them in respect thereof, except that nothing in this Agreement will limit or exclude any liability for fraud or fraudulent misrepresentation.

  1. Our staffs, agents and personal trainers are not medically qualified, where the Member has any doubts about his/her fitness or capability to exercise, GlamFit strongly recommend that him/her get advice from a doctor first. For safety reasons, all Members are responsible for the correct usage of Glamfit’s facilities. If the Member is not sure on how to use any equipment in Glamfit, always ask our available staffs, agents or personal trainers.
  2. The Member hereby warrants and represents that she is good physical condition and that the Member know of no medical or other reason of not capable of engaging in active or passive exercise and that such exercise would not be detrimental to the health, safety, comfort or physical condition.
  3. The Member shall not use any club facilities whilst suffering from any infections or contagious illness, disease or other ailments such as open cuts, abrasion, open sores or minor infection, where there is risk that such use may be detrimental to the health, safety, comfort or physical condition of the other Members.
  4. The Member and her authorized guests shall exercise and use the facilities at their own risk and are advised to consult their physician prior to commencing any type of physical exercise.

 

  1. Non-registered member must complete a per-entry form and pay an entry fee of RM20.
  2. Once completed, the non-registered Member will be treated as a “Per-Entry Member”.
  3. Per-Entry Members will have the same membership privileges (except personal training and classes) and must abide to the rules and limitations of liability of Glamfit as a Member.
  4. Per-Entry Members are not allowed to join on-going classes unless the Per-Entry Members pay for the class.
  5. The Management reserves the rights to adjust the per-entry fees without any notice.
  6. Per-Entry Members will be subject to the same rules and limitations of liability that applies to Members of Glamfit.

 

  1. All Members are encouraged to fix an appointment to undertake a fitness evaluation conducted by a fitness instructor before starting an exercise program.
  2. Members should be considerate of other Members and wipe down the equipment with a hand towel after each use.
  3. Fitness instructors are authorized to stop anyone from exercising if she is considered exercising in a manner that many result in personal injury or/and injury to others. Members must abide by the instructions of the fitness instructor.
  4. Smoking is not permitted within Glamfit’s premise.
  5. Members and/or its authorized guests and/or Per-Entry Members may not use the facilities of Glamfit while under the influence of alcohol, drugs, narcotics or other mood-altering substance.

 

All Members and/or its authorized guests are required to wear proper gym attire when exercising in Glamfit. A top is required that covers the chest area, no torn clothes are permitted including but not limited to jeans and crocs shoes. Sport shoes are required at all times in the gymnasium and in the aerobics rooms of Glamfit.

  1. The Management accepts no responsibility for loss or damage to Member’s contents kept in daily lockers for any reason whatsoever.
  2. The use of mobile phones with camera features and/or any other types of visual recorders in changing rooms are strictly prohibited. Members breaching this rule will be handed over to the authorities to be dealt with according.
  3. The Management may from time to time show potential members or others around the club and allow them to use Glamfit’s facilities on a trial basis and reserves the right to do so.
  4. A fee is chargeable for any damages dealt to the Glamfit’s facilities and/or equipment for restoration purposes.

 

For matters relating to personal data, please refer to our Privacy Policy.

  1. Soliciting and selling private personal training sessions or merchandises to any members are prohibited and shall result in immediate termination of the membership of the Member concerned.
  2. All lockers must be cleared daily. Unclaimed or lost properties will be kept by Glamfit for a period of one (1) month after which the Management reserve the rights to dispose of the items in any way it sees fit. No claims shall be entertained after this period.
  3. The management reserves the right to use any individual or group photographs of Members and/or its authorized guests for press or promotional purpose.
  4. All Members must abide by the rules of Glamfit which may be amended, varied, deleted and added from time to time at Management’s discretion.
  5. Failure by the Management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
  6. Glamfit reserves the right to proceed with legal action to any Member caught distributing, sharing or supplying such contents to any third party vendor or competitor.
  7. Any Member that misuses the emergency button/AED will be imposed with penalty fees.
  8. Any Member or its authorized guests who caused damages to the property, gym equipment, accessories and facilities of Glamfit shall be responsible for the repair bill as ascertained by Glamfit.

 

In consideration for the Management accepting his/her application for membership of Glamfit and for the Member to become and remain a Member of Glamfit, the Member agrees that:

  1. Glamfit accepts no responsibility for loss or damage on Members or their guests’ properties or for the death or injuries sustained while on the premises. Members and their guests agree that no claims will be made against the Company, Glamfit, the Management, staff and/or personal trainers for any reason whatsoever.
  2. Glamfit, its associated companies, employees shall not be responsible for any claims, demands, injuries, damage or theft to a member’s person or property arising out of or in connection with the use by a Member of any of the services, facilities on the premises of Glamfit. The Member hereby holds the Company, Glamfit, its associated companies and employees harmless from all claims which may be brought against them by or on a Member’s behalf for any such injuries or claims aforesaid.
  3. Per-Entry Members and/or Member’s authorized guests shall abide with the club rules and the same limitation of liabilities that applies to a Member.
  4. The Member hereby acknowledges, represents and warrants that the usage of facilities at Glamfit involves risk of injury to the Member, other members or guests, whether caused by the Member or someone else. The Member understands and voluntarily accepts this risk. The Member warrants and represents that the Member has consulted with a doctor prior to the start of any exercise programs. The Member agrees to hold Glamfit, its employees, directors, the Management harmless of any liabilities for injury including, without limitation, personal, physical or mental injury, economic loss, or any damage to the Member or its authorized guests as the consequence of the Member’s acts and the acts of anyone by using the facilities of Glamfit. The Member agree to be responsible for all liabilities and damage suffered for any injury sustained, including, without limitation, physical or mental injury, economic loss, or any damage to another member caused by the Member whether deliberately or otherwise or through negligent action or omission. If any claim is made by anyone based on any injury, loss, or damage as described here in, which involves the Member or its authorized guests, the Member agree to (i) defend Glamfit, its employees, directors, the management against such claims and pay Glamfit, its employees, directors, the management for all expenses including legal fees relating to the claim, (ii) indemnify Glamfit, its employees, directors, the management for all liabilities to the Member resulting from such claims, and (iii) hold Glamfit, its employees, directors, the management harmless from any claims, lawsuits and indemnification.

 

The terms and conditions herein are to be construed in accordance with laws of Malaysia and any disputes will be decided by a court of Malaysia.

**Glamfit may add or delete or change any of the terms and conditions contained herein at its sole and absolute discretion. Any such additions, deletions or changes will be notified to the members through a media as GlamFit deems appropriate and/or notice in Glamfit facilities.
